Step Parent Parental Responsibility in the UK

Step Parents Parental Responsibility: Your Rights

stepfather with step children -Step parent Parental Responsibility UK

When someone forms a relationship with a person who already has children, they often take on a meaningful role in the child’s life. But when it comes to step parent parental responsibility in England and Wales, rights and responsibilities are not automatic. So, can a step parent get parental responsibility – and if so, how?

In this blog, we explain what parental responsibility means, whether a step parent can obtain it, and the legal options available.

What is Parental Responsibility?

Parental responsibility, often referred to as PR, is defined under the Children Act 1989 as:

“All the rights, duties, powers, responsibilities and authority which by law a parent has in relation to the child and their property.”

This includes decisions around:

  • Education and schooling
  • Medical care and treatment
  • Religion
  • Travelling abroad with the child
  • Legal matters affecting the child’s welfare

In England and Wales:

  • The biological mother automatically has parental responsibility from birth.
  • A father has PR if he was married to the mother at the time of the child’s birth, or if he is named on the birth certificate (for births registered after 1st December 2003).

There is no law about when children meet a new partner, so it is a conversation the two of you have to have. Our accredited family mediators give you somewhere calm to have it, usually in one or two sessions.

Does a Step Parent Automatically Have Parental Responsibility?

No. A step parent does not automatically gain parental responsibility, even if they marry or enter into a civil partnership with the child’s biological parent. However, there are legal routes available for them to obtain it.

How Can a Step Parent Obtain Parental Responsibility?

There are four main legal routes to obtain step parent parental responsibility:

1. Parental Responsibility Agreement

A step parent can enter into a PR agreement with the biological parent(s) who already hold PR. This:

  • Must be signed by all parties.
  • Needs to be registered at the Family Court to be valid.

2. Parental Responsibility Order

If agreement isn’t possible, a step parent can apply to the court for a PR order. This application will be made on a Form C1 and you will need to have a mediator sign a FM1 form to show you have attended a MIAM. (Do not use a Form C100 for this situation)The court will consider:

  • Their involvement in the child’s life.
  • Whether it’s in the child’s best interests.

3. Child Arrangements Order (Lives With Order)

If the court grants a ‘lives with’ order stating the child will live with the step parent, this automatically gives them parental responsibility – for as long as the order is in place.

4. Adoption

A step parent can apply to adopt their step child, which permanently gives them all the legal rights and responsibilities of a parent. This is a complex process and requires:

  • Consent from all individuals with PR.
  • A thorough assessment by the local authority.

What Can a Step-Parent Do Without Parental Responsibility?

Even without step parent parental responsibility, a step-parent may:

  • Provide day-to-day care with the agreement of the biological parent.
  • Act in emergencies to protect the child.
  • Be involved in family life, socially and emotionally.

However without step-parent parental responsibility, they cannot:

  • Make legal decisions on schooling, medical treatment, or passports.
  • Prevent the child from being removed from the country.
  • Access school or medical records without authorisation.

Why Parental Responsibility Matters

Having PR means the step parent can legally:

  • Consent to medical treatment.
  • Be involved in decisions about education and welfare.
  • Travel abroad with the child for up to 2 weeks (with consent from others with PR or a court order).
  • Deal with legal matters that involve the child.
  • Be responsible for the child if the biological parent dies.

What Happens if the Relationship Ends?

If a step parent has been granted parental responsibility and later separates from the child’s biological parent, their PR does not automatically end.

However, the court can remove parental responsibility if it is no longer in the child’s best interests. This would usually require a court application from another person with PR and is only done in extreme circumstances.

Can Family Mediation Help?

Yes. If you’re a step parent hoping to gain parental responsibility, or a biological parent considering allowing step parent parental responsibility to your ex’s new partner, family mediation can be a helpful first step.

Mediation allows both parties to explore their options with a trained, neutral family mediator. Discussions can cover:

  • Whether PR is appropriate.
  • The best outcome for the child.
  • Formalising agreements.
